European Commissioner for the internal market, Thierry Breton, issued a warning to major social media platforms like Meta, TikTok, and X (formerly Twitter), urging them to remain vigilant and comply with regulations against illegal online content. Unlike the United States, where the First Amendment protects various forms of free speech, Europe imposes stricter rules under the Digital Services Act, backed by the threat of penalties for non-compliance. This divergence in regulatory approach has raised questions about the effectiveness and legality of such measures.

Under the Digital Services Act (DSA), large online platforms are required to implement robust procedures for removing hate speech and disinformation. Breton’s warning serves as an alert to these platforms that the European Commission is closely monitoring their actions. Non-compliance with EU regulations could result in fines of up to 6% of their global annual revenues. While the DSA seeks to strike a balance between combating online harm and protecting free expression, the potential risk of penalties raises concerns about the scope of governmental power and possible infringement on the rights of these platforms.

Contrary to Europe, the United States lacks a legal definition of hate speech or disinformation under the Constitution. First Amendment specialist Kevin Goldberg explains that while there are narrow exemptions for certain forms of speech, the U.S. government cannot exert the same level of pressure on social media platforms as seen in Europe. The absence of a legal basis for regulating hate speech or disinformation limits the government’s ability to coerce content moderation. Goldberg further asserts that excessive coercion can itself be a form of regulation, even if not explicitly stated as punishment.

In the U.S., efforts by the government to moderate misinformation, particularly during elections and the COVID-19 pandemic, have faced legal challenges. State attorneys general, primarily Republicans, have argued that the Biden administration’s suggestions to social media platforms to remove certain posts were overly coercive and violated the First Amendment. An appeals court ruling has cast doubt on the constitutionality of such interventions, prompting the Biden administration to await the Supreme Court’s decision on the matter. The U.S. government’s limited authority, coupled with the protection afforded by the First Amendment, raises questions about the extent to which government officials can influence content moderation on social media platforms.

While Europe adopts stricter regulations, the question arises as to whether these policies will have a global effect. Historically, technology companies have often implemented policies, like the European Union’s General Data Privacy Regulation (GDPR), across multiple jurisdictions. However, the tech industry may choose to limit the application of these new regulations to European countries. The impact on content moderation practices worldwide remains uncertain.
